Terms of Service

1. Acceptance of Terms

By accessing or using CoursHub Creator ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms form a legal agreement between you and CoursHub Creator ("we," "us," or "our").

2. Description of Service

CoursHub Creator is a browser-based course authoring platform. The Service lets users create interactive lessons, quizzes, glossaries, 360-degree scenes, and interactive videos, then export them in formats including SCORM 1.2, SCORM 2004, standalone HTML, and PDF.

We may modify, add, or remove features at any time. We will give reasonable notice of material changes that affect paid functionality.

3. Account Registration

To use most features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Keep your account credentials confidential
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activity that occurs under your account

You must be at least 13 years old to create an account. If you create an account on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. Your Content

You retain all rights to the content you create using the Service ("Your Content"), including courses, quizzes, glossaries, images, video, and other materials you upload or author.

You grant us a limited, non-exclusive, royalty-free license to host, store, copy, process, and display Your Content solely as needed to operate the Service for you. We do not use Your Content to train AI models, sell to third parties, or for any purpose other than providing the Service.

You represent and warrant that:

  • You own or have the necessary rights to all content you upload
  • Your Content does not infringe any third party's intellectual property rights
  • Your Content does not violate any applicable law or regulation

5. Acceptable Use

You agree not to use the Service to:

  • Upload, create, or distribute content that is illegal, harmful, defamatory, or violates the rights of others
  • Upload content that contains malware, viruses, or other malicious code
  • Attempt to gain unauthorized access to the Service, other accounts, or any networks connected to the Service
  • Use automated means (bots, scrapers) to access the Service without our written permission
  • Resell, sublicense, or redistribute the Service itself to third parties
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use the Service to send spam, phishing, or other unsolicited communications
  • Interfere with or disrupt the integrity or performance of the Service

6. Subscription, Payment, and Cancellation

Paid plans are billed monthly in advance through our payment processor (Stripe). By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Cancellation: You may cancel your subscription at any time through the customer portal. After cancellation, you will retain access through the end of your current billing period. We do not provide refunds for partial months.

Refunds: Refunds are not offered for unused time on a subscription. If you experience a technical issue that prevents you from using the Service, contact us and we will work to resolve the issue or, at our discretion, provide a refund or credit.

Price changes: We may change subscription prices with at least 30 days' notice before the change applies to your account.

Failed payments: If a payment fails, we may suspend or terminate your access to paid features until the issue is resolved.

7. Intellectual Property

The Service, including its software, design, logos, and trademarks, is owned by CoursHub Creator and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

You may not copy, modify, distribute, sell, or lease any part of the Service or its underlying software except as expressly permitted.

8. Termination

You may terminate your account at any time by canceling your subscription and requesting account deletion through the customer portal or by contacting us.

We may suspend or terminate your access to the Service if you violate these Terms, if your account becomes inactive for an extended period, or if we discontinue the Service. We will provide reasonable notice except in cases of urgent security or legal concerns.

Upon termination, your right to use the Service ends immediately. You may export Your Content before termination. After termination, we may retain or delete Your Content according to our data retention practices described in our Privacy Policy.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not warrant the accuracy, reliability, or completeness of any content created using the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COURSHUB CREATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold CoursHub Creator harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service in violation of these Terms
  • Your Content, including any claim that it infringes a third party's rights
  • Your violation of any applicable law or regulation

12. Governing Law and Disputes

These Terms are governed by the laws of the State of [Your State], United States, without regard to its conflict of laws principles. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in [Your County and State], and you consent to the personal jurisdiction of those courts.

13. Changes to These Terms

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and CoursHub Creator regarding the Service.
